1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement between you ("Client," "you," or "your") and mosswopmy ("we," "us," or "our") regarding your use of our watch repair and maintenance services. By engaging our services or accessing our website, you agree to be bound by these terms.

If you do not agree to these terms, please do not use our services. We reserve the right to modify these terms at any time, and your continued use of our services after changes indicates acceptance of the modified terms.

2. Definitions

For purposes of these Terms and Conditions:

  • "Services" refers to all watch repair, maintenance, consultation, and related services provided by mosswopmy
  • "Timepiece" or "Watch" means any watch, clock, or timepiece submitted for service
  • "Client" means the individual or entity requesting and paying for services
  • "Workshop" refers to our physical service location in George Town, Penang
  • "Agreement" means these Terms and Conditions along with any service-specific terms

3. Service Description

mosswopmy provides watch repair and maintenance services including but not limited to:

  • Automatic module conversion assessments
  • Tropical climate care packages
  • Watch winder calibration
  • Movement servicing and regulation
  • Water-resistance testing and gasket replacement
  • Case and bracelet restoration

Service availability and scope may vary based on the specific timepiece and required work. All services are subject to initial assessment and mutual agreement before work commences.

4. Service Process

4.1 Initial Consultation

Upon receiving your timepiece, we conduct an initial assessment to determine the condition, required services, and estimated timeline. We will provide you with a detailed explanation of recommended work and associated costs before proceeding.

4.2 Client Approval

No service work will commence without your express approval of the scope and cost. If additional issues are discovered during service, we will contact you for approval before proceeding with any work beyond the original scope.

4.3 Service Timeline

Estimated completion times are provided in good faith but are not guaranteed. Delays may occur due to parts availability, unexpected complications, or other factors beyond our control. We will notify you promptly of any significant delays.

4.4 Collection

Upon completion, we will contact you for collection. Timepieces must be collected within 90 days of completion. After this period, storage fees of MYR 50 per month may apply.

5. Pricing and Payment

5.1 Service Fees

All prices are quoted in Malaysian Ringgit (MYR) and are subject to change. Current pricing is available on our website or upon request. Quoted prices remain valid for 30 days unless otherwise stated.

5.2 Payment Terms

Payment is due in full upon collection of your timepiece. We accept cash, bank transfer, and major credit cards. A non-refundable deposit may be required for services exceeding MYR 1,000.

5.3 Additional Costs

If additional work becomes necessary during service, we will contact you with a revised estimate. You may choose to proceed with the additional work, authorize completion of only the original scope, or cancel the service (subject to cancellation terms).

6. Client Responsibilities

As a client, you agree to:

  • Provide accurate information about your timepiece and its condition
  • Disclose any known defects, previous repairs, or modifications
  • Maintain insurance coverage for valuable timepieces during service
  • Collect your timepiece within a reasonable time after service completion
  • Pay all fees in full and on time
  • Follow care and maintenance recommendations provided

7. Warranty and Service Guarantee

7.1 Service Warranty

We warrant our workmanship for a period of 12 months from the date of service completion. This warranty covers defects in our workmanship but does not cover:

  • Normal wear and tear
  • Damage from accidents, misuse, or improper care
  • Repairs performed by third parties after our service
  • Parts not replaced during service
  • Issues unrelated to the work we performed

7.2 Parts Warranty

Replacement parts carry the manufacturer's warranty where applicable. We do not warrant the performance or longevity of original parts that remain in the timepiece after service.

7.3 Water Resistance

Water-resistance testing reflects the condition at the time of testing. Water resistance is not permanent and gaskets should be checked annually, particularly in tropical climates. We recommend annual testing for watches exposed to water or high humidity.

8. Limitation of Liability

8.1 Service Limitations

Watch repair inherently involves some risk. While we take all reasonable precautions, we cannot guarantee perfect results in all cases, particularly with vintage, damaged, or previously modified timepieces.

8.2 Maximum Liability

Our liability for any claim arising from our services is limited to the lesser of: the actual value of the timepiece at the time of service, or the amount paid for the service. We are not liable for consequential, incidental, or indirect damages.

8.3 Insurance Recommendation

We strongly recommend that clients maintain comprehensive insurance coverage for valuable timepieces. We maintain secure storage but cannot accept responsibility beyond the limitations stated herein.

9. Cancellation and Refunds

9.1 Client Cancellation

You may cancel service before work begins at no charge. If work has commenced, you will be responsible for the cost of work performed, parts used, and any non-refundable deposits.

9.2 Our Right to Refuse Service

We reserve the right to decline or discontinue service if we determine that the work cannot be completed safely, that the timepiece requires specialized expertise we do not possess, or if we suspect the timepiece may be stolen or counterfeit.

9.3 Refund Policy

If we are unable to complete agreed-upon services, any fees paid will be refunded after deduction for work performed and materials used. Assessment fees are generally non-refundable.

10. Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of mosswopmy or our content suppliers and is protected by Malaysian and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.

11. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and the Malaysian Personal Data Protection Act 2010. Please review our Privacy Policy for details on how we handle your data.

12. Dispute Resolution

12.1 Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Penang, Malaysia.

12.2 Informal Resolution

In the event of any dispute, we encourage you to contact us first to seek an informal resolution. Most concerns can be addressed through direct communication.

12.3 Mediation

If informal resolution is unsuccessful, both parties agree to attempt mediation before pursuing litigation. Mediation costs shall be shared equally unless otherwise agreed.

13. General Provisions

13.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and mosswopmy regarding our services.

13.2 Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights.

13.4 Assignment

You may not assign or transfer your rights under these terms without our written consent. We may assign our rights and obligations without restriction.

14. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.
